The bank (First National Bank of Brownwood) sued Roy Hickman and his son Roy Hickman, Jr., upon a promissory note executed by them in favor of the bank, and joined Mrs. Nettie Hickman, the divorced former wife of Roy Hickman, seeking to hold her personally on the note, on the ground that it was a debt of the community estate of herself and Roy Hickman, and that she had received in a partition of the estate property in excess of the note, which she had appropriated to her own use; and also seeking to subject to the payment of the note property still in her hands, which she had received in the…
