R. N. Burlingame, respondent, was convicted of arson. He owned and conducted a drug store on, the ground floor of a two-story building in Albion, Michigan. The suite of rooms over the store had been continuously vacant for a long period previous to April 22, 1931. On the evening of that day a fire broke out in one of the rooms. A fire had visited respondent’s store in 1928 and again in 1930.
