Defendant moves to vacate his judgment of conviction.

On March 23, 1987, defendant was convicted after a jury trial of the crimes of manslaughter in the first degree, assault in the second degree and criminal possession of a weapon in the second degree. On June 23, 1987, he moved to set aside *967the verdict pursuant to CPL 330.30. On August 6, 1987, the court denied the motion and on August 7, 1987, the court sentenced defendant.
