—In an action pursuant to Civil Rights Law § 51 to recover damages for an alleged violation of Civil Rights Law § 50, the defendant appeals from an order of the Supreme Court, Orange County (Sherwood, J.), entered August 29, 1995, which denied its motion to dismiss the complaint pursuant to CPLR 3211 (a) (7).
Ordered that the order is reversed, on the law, with costs, the motion is granted, and the complaint is dismissed.
