I. INTRODUCTION
Defendant Karl Demmler was indicted on obstruction-of-justice and witness-tampering charges on October 23, 2007. The Government moved for an order detaining Demmler pending trial. Following an evi-dentiary hearing, Magistrate Judge Kemp held that the Government had not sustained its burden of establishing that Dem-mler is either a flight risk or dangerous, such that it is necessary to detain him prior to trial.
