The object of this submission is to obtain a judicial construction of the ninth or residuary clause of the will of Mrs. Caroline Moore, late of Buffalo, deceased. The defendant, Mrs. Graves, was the adopted daughter of the testatrix, and the plaintiff is the son and one of seven children of Mrs. Graves, who were living at the time of the death of Mrs. Moore. The clause in question reads as follows: “I do give, devise, and bequeath all the rest, residue, and remainder of my property and estate, both real, personal, and mixed, of every name and nature, and wherever situate, to my adopted…
