Plaintiffs in the underlying suit below, Marilyn Byrd and Karen Hess, were injured *476in the course of their employment at the Rival Company. They filed a lawsuit in the Jackson County circuit court pursuant to § 287.780, RSMo 1994, alleging that Rival discriminated against them because they retained counsel and filed workers’ compensation claims.
