Judgment unanimously affirmed. Memorandum: Defendants were indicted for murder in the second degree, conspiracy in the second degree and criminal facilitation in the second degree in connection with the shooting death of one Randolph “Bay” Grace at the Grimoire Tavern in the Town of Onondaga on April 16, 1978. After a jury trial, defendants were acquitted of *944the murder charge and convicted of criminal facilitation in the second degree. The conspiracy charge was dismissed by the court.
