This suit was instituted in the justice of the peace court by appellee to recover from the appellant $13.55, wages due him, and penalty for their nonpayment. On the day of trial the appellant paid the wages due, and judgment was entered against the appellant for $128.40 penalty.

An appeal was prosecuted to the circuit court, where the case was tried before a .jury, which returned a verdict in favor of appellee in the sum of $128.40, and judgment was entered accordingly. The case is here on appeal.
