In deference to the opinion of his Honor, who intimated at the close of the testimony that the plaintiff could not recover, the plaintiff submitted to a non-suit and appealed.

This is an action by plaintiff to recover a debt” origin ally due from defendant to the Buttan Manufacturing Co., and by it assigned to the plaintiff; and the first matter that demands our attention is a motion of defendant to dismiss the appeal for the reason'that the record has not been printed as the rules of this Court require. Upon examination of the printed record we find that it is not as complete as it should have been for our convenience.
