*1164Defendant was indicted and charged with criminal sale of a controlled substance in the third degree (two counts), criminally using drug paraphernalia in the second degree, and unlawful possession of marihuana1 in connection with two “controlled buys” in the City of Albany. Following a jury trial, defendant was convicted of criminal sale of a controlled substance in the third degree (two counts), acquitted of criminally using drug paraphernalia in the second degree and sentenced as a second felony offender to an aggregate prison term of 12 years with three years of postrelease supervision.…
