In a proceeding under CPLR article 78 to compel respondents to reinstate petitioner to his position of teacher of driver education in the respondent school district, petitioner appeals from a judgment of the Supreme Court, Nassau County, entered September 8, 1967, which dismissed his petition. Judgment reversed, on the law and the facts, without costs, and petition granted. Findings of fact inconsistent herewith are reversed and new findings are made as indicated herein.
