INTRODUCTION
Before the Court is a Complaint filed by Plaintiff, Alliance Shippers, Inc. (“Alliance”) against Defendant/Debtor, Joseph T. Guarraeino (“Defendant”), seeking to determine the non-dischargeability of a debt pursuant to 11 U.S.C. § 523(a)(4). Alliance brought this action, in its capacity as an assignee of a debt arising from a statutory trust, pursuant to the Perishable Agricultural Commodities Act (“PACA”), 7 U.S.C. §§ 499a, et seq.
