Oscar Porter was convicted of the offense of assault with intent to murder. It appeared on the trial that the marshal of the town of Lumpkin was approached by a negro, John Anderson, upon the public square of the town, and requested to arrest the defendant upon a charge of disorderly conduct. The defendant was at the time but a short distance from the marshal, and had full opportunity to observe the marshal and Anderson in conversation.
