At the time of the filing of this suit in the district court of Dallas county, the following state of facts.existed in reference to the subject-matter of litigation:
Jas. P. Johnston owned an estate for life in a tract of 50 acres of land adjoining the corporate limits of the city of Dallas and, as such owner, was in possession .of said land and had been in possession for a number of years, collecting the rents and revenues on same.
