Appeal by the plaintiff, James P. Hayes, from an order of the Supreme Court, made at the Westchester Special Term and entered in the office of the clerk of the county of Westchester on the 9th day of October, 1897, changing the place of trial from Westchester • county to Monroe county on a motion made upon the grounds that Westchester county, the county designated for trial in the complaint, is not the proper county; that Monroe county is the proper county, and that the convenience of witnesses and the' ends of justice will be promoted by such change.

The action is brought by the assignee of a judgment creditor against the defendants therein and one Bertha 0. Garson to reach certain assets of the .defendants, on the ground of their collusion in securing a preferential application of-such assets upon judgments obtained by said Bertha 0. Garson upon alleged fraudulent causes of action. The complaint alleges that the defendants Moses L. Garson and James 0.
