DUNKLIN, Associate Justice.

By the terms of a parol contract between Herman Strauss and J. H. Peters the former agreed to convey to the latter eight hundred and twenty-three acres of land in Lipscomb County, Texas, and Peters agreed to convey to Strauss certain lots and a hotel building, together with hotel furniture, all situated in Selden, Kansas. Strauss executed a deed to the Lipscomb County land purporting to convey it to Peters, and the same was placed in -a bank in Shattuck, Oklahoma, but it was subsequently withdrawn therefrom by Strauss.
