— In a medical malpractice action to recover damages for wrongful death, etc., defendant Desner appeals from an order of the Supreme Court, Nassau County (Roncallo, J.), dated October 7, 1982, which (1) denied his motion for summary judgment and (2) granted plaintiff’s cross motion to vacate a prior order of preclusion. Order reversed, on the law, with costs, appellant’s motion for summary judgment is granted and plaintiff’s cross motion is denied..
