After trial by jury, Carl Joseph Davis, was convicted of attempted first degree murder and was sentenced to twenty-five years. On direct appeal, the judgment was affirmed without opinion. State v. Davis, 360 So.2d 183 (La.1978). The state trial court denied habeas corpus relief and the Louisiana Supreme Court denied Davis’ application for remedial writs. Davis then filed an application for habeas corpus in federal district court. The magistrate rec ommended denial of habeas corpus relief on the basis of the state record.
