MORRISON, Presiding Judge.

The offense is assault with intent to murder, the punishment, 15 years.

Rosenbaum, a 60-year-old police officer of the City of Terrell, was severely beaten by the appellant and his companion Hardy. It was five days before Rosenbaum regained consciousness, two weeks until he was released from the hospital, and the wounds which he sustained were considered serious by the doctors who treated him. The assault occurred when Rosenbaum attempted to place the appellant and Hardy under arrest, and immediately following the assault the appellant and Hardy fled. The appellant…
