A motion was entered herein by defendant in error to dismiss the writ of error for want of jurisdiction. The action was case, brought by plaintiffs in error, to recover damages for negligently causing the death of their intestate. Damages were claimed in the declaration in the sum of $5000. There was' a jury trial in the circuit court on a plea of not guilty, and the verdict was for defendant in error, and a judgment was rendered thereon against plaintiffs in error for costs.
