In the disposition of the appeal as made in the original opinion of the court the writer concurred. The concurrence, however, was based upon different conclusions from those reached by the majority. The opinion of the majority on rehearing, which supersedes the former opinion, brings us more nearly into agreement than before; but because of the views of the writer not shared by his associates, we are now in disagreement as to the proper disposition of the appeal.
