A jury in the Superior Court acquitted the *483defendant on charges of aggravated rape and rape, and convicted him on charges of indecent assault and battery on a person over the age of fourteen years and assault and battery. The charges stemmed from accusations by the complainant that the defendant, and his friend, Michael O’Connor, had sexually assaulted her. The defendant and O’Connor were tried together, and the jury acquitted O’Connor of all charges, which included charges of aggravated rape, indecent assault and battery, and assault and battery.
