Defendanb-AppellanNCross-Appellee Liberty Life Assurance Company of Bos-, ton (“Liberty”) appeals the district court’s denial of its motion for summary judgment and that court’s grant of summary judgment in favor of plaintiff-appellee-cross-appellant Linda Ellis (“Ellis”). The district court concluded that no genuine issue of material fact existed as to Ellis’s claim under the Employee Retirement Income Security Act (“ERISA”), 29 U.S.C. § 1001, et seq., and that she was entitled to summary judgment.
