delivered the opinion of the court.. This case comes before the court upon appeal from the judgment of the Supreme Court of the Territory of Minnesota, before its admission into the Union as a State.

It appears that a suit was instituted in the District Court-, in the county of Ramsey, by Wakefield, the appellee, against the appellant and others, in order to foreclose a mortgage' made by the said Brewster and his wife, of certain lands, to secure the payment of three promissory notes mentioned in the proceedings.
