Van Gilder, defendant in error, as Receiver of the German-American Indemnity Company, plaintiff below, brought this action against the First National Bank of Lafayette, Colorado, to recover on the bank’s two certificatés of deposit issued to the Indemnity Company before its insolvency, and which later came into the possession of the receiver as part of its assets.
