The validity of the information is attacked on the •ground that it is based on matters not disclosed in the proceedings before the committing magistrate, whereby the defendant was then •deprived of his “legal” day in court, and was not afforded an opportunity to meet and combat the actual charge upon which the district attorney insists he shall .now be tried.
