MEMORANDUM AND ORDER

Presently before the Court is defendant’s motion to dismiss the plaintiff’s complaint. In its motion the defendant contends that (1) the claim of plaintiff under Title VII, 42 U.S.C. § 2000e et seq. must be dismissed for lack of subject matter jurisdiction because the plaintiff has failed to comply with the procedural prerequisites required by the Act for filing such a complaint; (2) the plaintiff has failed to state a cause of action under 42 U.S.C. § 1983 because there is no “state action”; (3) this Court does not have jurisdiction with respect…
