From the allegations of the amended bill filed herein, it appears that the German Savings Bank of Omaha, *536being in financial straits was, by vote of its directors, placed in the hands of the state banking board as provided by sections 34 and 35 of chapter '8 of the Compiled Statutes of Nebraska, for 1903, on July 9, 1896; that on July 23, 1896, on petition filed by the Attorney General in the district court of Douglas county, Nebraska, one McCague was appointed receiver under the provisions of the statutes of the state of Nebraska, and duly qualified.
