Auto-Owners (Mutual) Insurance Company filed a declaratory judgment action in the district court, seeking a ruling that it had no duty to defend or indemnify L.P. Cavett Company and L.P. Cavett Company of Indiana, Inc. and their co-defendants in a personal injury action pending in an Indiana state court. The district court granted Auto-Owners’ motion for summary judgment, relying in part upon existing precedent from this court.
