Proceeding pursuant to CPLR article 78 to review a determination of the respondent New York State Department of Environmental Conservation (hereinafter the DEC), dated September 3, 1985, which, after a hearing, directed that a tidal wetlands map pertaining to certain real property located in the Town of Hempstead be amended to reclassify a portion of property owned by the petitioner Merrick Jewish Centre, Inc.

Adjudged that the determination is confirmed and the proceeding is dismissed on the merits, with costs.
