This case is before the Court on Defendant and Third Party Plaintiff’s Motion for Partial Summary Judgment, filed November 2, 1981; Plaintiffs’ response thereto, filed December 4, 1981; and Defendant’s Reply to Plaintiffs’ Response, filed December 24, 1981.
