WINGATE, District Judge.
This matter is before the court pursuant to the motion of the plaintiff Rudy Lewis, administrator of the estate of Alvin B. Johnson, asking this court to abstain and remand this matter to the Circuit Court of the First Judicial District of Hinds County, Mississippi. On May 17, 1994, the defendant, Allstate Insurance Company, removed this matter from state court to this federal court pursuant to Title 28 U.S.C. §§ 1441 1 and 1332. 2 Upon removal, this action (writ of garnishment) was consolidated with Allstate’s pending federal court action for declaratory judgment…
