OPINION

SIMANDLE, District Judge.

On January 15, 2003, defendant Cory Carmichael was convicted by a jury upon a one-count indictment of being a felon in possession of a firearm, in violation of 18 U.S.C. § 922(g)(1). Defendant then filed a motion for a Judgment of Acquittal notwithstanding the verdict, pursuant to Federal Rule of Criminal Procedure 29(c), and, in the alternative, a new trial based upon newly discovered evidence, pursuant to Federal Rule of Criminal Procedure 33.
