The appellees, Lee Fyffe and Cynthia Holsen, filed a bill in the circuit court of Lawrence county to partition the northwest quarter of the northeast quarter of section 31, town 4 north, range 12 west of the second principal meridian, containing 38.71 acres.. The land was owned at the time of her death, on September 30, 1893, by Ella Fyffe. She died intestate, leaving her husband, Charles Fyffe, and their four children, Grace, Roy, Pearl and Julia, her heirs.
