Appeal from a judgment in the Seventeenth District Court, County of Los Angeles, Sepulveda, J., and from an order denying a motion for a new trial in the Superior Court of Los Angeles County by the same Judge. ■ A decision in this case was made by Department Two, January 6th, 1881, affirming the order denying a new trial.

In this action, which was brought to foreclose a mortgage by one claiming to be the assignee of the note and mortgage sued on, the sole mortgagor, José Dolores Ruiz, together with Dolores S. de Abila and D. B. Hoffman, were made defend*13ants. The note and mortgage above mentioned were executed on the 27th of June, 1877. The defendants, failing to answer, were regularly defaulted.
