SHEPHERD, Circuit Judge.
On November 1, 2007, Roderick McArthur was indicted on one count of possession of child pornography, in violation of 18 U.S.C. § 2252A(a)(5)(B) and 2252A(b)(2). McArthur filed a motion to suppress evidence, and an evidentiary hearing was held before a federal magistrate judge. 1 On January 25, 2008, the magistrate judge issued a Report and Recommendation (“R & R”) recommending denial of the motion to suppress.
