Action by the United States on a distiller’s bond to recover unpaid taxes on spirits removed from a warehouse.

(orally). The plaintiff declares upon a bond, the conditions of which are as follows:

“If the said James B. Richardson shall, in all respects, faithfully comply With all the provisions of law relating to the duties and business of distillery *894and shall pay all penalties incurred or fines imposed on him for a violation of any of the said provisions,” etc.

The facts ate agreed that defendant Richardson was a distiller, and executed the bond set out, with the conditions therein recited, and the distilled spirits placed in the distillery warehouse were removed therefrom without the payment of tire…
