This proceeding was brought by a state bank, whose principal place of business is at Great Falls, to restrain the assessor of Cascade county from placing the bank stock of relator's shareholders in class 6 of section 1999 of the Eevised Codes of 1921, and from placing the stock in any other class than 5.

The petition shows that the bank is carrying on a general banking business in this state, with a capital of $250,000, divided into 2,500 shares of the par value of $100 each, its shares being owned and held by persons both within and without the state; that in accordance with the laws of this…
