This is an insurance fraud case. Appellant Joseph Manning was convicted of a class “A” misdemeanor theft, and the jury assessed punishment by a fine of $1,155. See Tex.Penal Code Ann. § 31.03(e)(3) (Vernon Supp.2001). Manning was accused of stealing money from Farmer’s Insurance Company by making a false claim under his homeowner’s insurance policy. The indictment against Manning named Gabe Ramirez, an agent for Farmer’s Insurance Company, as a “special owner” of the money.
