[1] The defendant and appellant has ruled the trial judge and the clerk of the district court to show cause why certain documents, upon which the judgment appealed from purports to have been (in part) predicated, and a certain supplemental statement of facts prepared by the trial judge, which, with the documents mentioned, has been copied in the transcript, should not be stricken therefrom, upon the grounds that the documents were not filed in evidence on the trial, and that the statement of facts was filed after the judge had been devested of…
