The New York Life Insurance Company (Plaintiff) brought this diversity action for breach of contract against G.H.C. Properties, Ltd., a limited partnership, B. M. Grantland, and B. J. Case (Defendants) seeking liquidated damages in the amount of $47,500.00 and an award of attorney’s fees. The Defendants denied liability and counter-claimed for the recovery of a $47,500.00 deposit which had been paid to the Plaintiff.
