MEMORANDUM OPINION AND ORDER
MOTLEY, District Judge.
On July 28, 1995, plaintiff Lynn A. Murphy (“Murphy”) filed an action against defendant/third-party plaintiff Keller Industries, Inc. (“Keller”) in the Supreme Court of the State of New York, Orange County. On August 31, 1995, Keller removed this action, pursuant to 28 U.S.C. § 1441 and § 1332, to the United States District Court for the Southern District of New York.
