This action was brought by the plaintiff, Murawska, against the defendant, Boeger, to recover a commission which the plaintiff claimed was due him on the sale of a cemetery known as the Oak Ridge Cemetery of Chicago. The cemetery was owned by a corporation, all the stock of which was owned by the defendant, his father and other members of the family. The down-town office of the cemetery company was in the National Life Building in Chicago. One Kirmse occupied an office with the cemetery company.
