The appellant was convicted of the crime of having sexual intercourse with an imbecile or idiotic woman, and was sentenced to imprisonment for five years in the penitentiary. The record contains three bills of exception.

The first bill was reserved to the ruling of .the trial judge permitting the district attorney to ask a juror, on the trial of a motion for a new trial, whether he had been influenced by the lack of comfort in the jury room in arriving at the verdict.
