This case arises on a petition for a declaratory judgment with regard to “the payment of debts and apportionment thereof” under the will of Charles J. Krejci. Plaintiff is the executor of the estate. It is alleged that the entire assets of the estate were ‘ ‘ specifically or demonstrably” devised or bequeathed in Items 2 through 5 of the will, and that the only exception is a general legacy in Item 6, having a value of $25.00.
