Tate, against • William Dalton," commissioner of water supply of the city of New York, for a peremptory writ of mandamus to forthwith reinstate relator as water registrar.' The relator was appointed to the office of water registrar of the city of Brooklyn on the 1st day of February, 1894, by the then Commissioner of city works of such city. He immediately entered upon and continued to discharge the duties of such office until *1061the cities of New York and Brooklyn were consolidated, pursuant to chapter 378 of the Laws of 1897. After consolidation the relator continued to discharge the same duties that he had previously performed, in the office of the commissioner of water supply of the city of New York, until the 8th day of April, 1898, when he was summarily…
