This suit was brought originally by W. C. Gholson, on April 23, 1923, against the plaintiff in error, the Texas Pacific Coal & Oil Company, a corporation, tov recover two installments of “ground rentals” alleged to have accrued under a certain oil and gas lease on October 23, 1920, and October 23, 1921, respectively. The lease in question was executed on October 23, 1917, by W. C. Gholson to the Texas Pacific Coal Company, a corporation, whose name was after-wards changed to the Texas Pacific Coal & Oil Company.
