FACTS AND PROCEDURAL HISTORY
Melvin Henderson was suspended and ultimately dismissed from his job as Public Works Supervisor 1 with the Sewerage and Water Board of New Orleans (the Board) on grounds of physically attacking his supervisor. Henderson appealed his termination to the Civil Service Commission (the Commission) and filed a Motion and Memorandum for Summary Disposition of Appeal in which he argued that the Board’s failure to afford him written notice of the reason(s) for his suspension and pre-termination hearing constituted a denial of procedural due process.
