Frank J. Kruse filed a complaint in the Jefferson Circuit Court (“the trial court”) against the City of Birmingham (“the City”), alleging claims of unjust enrichment, money had and received, and violation of 42 U.S.C. § 1983; Kruse also sought certain declaratory and injunctive relief. The basis of Kruse’s claims is the City’s attempts to obtain payment of fines for parking-violation citations that were issued to a vehicle registered to Kruse.
